Kerala High Court rules in favor of Air India

Mangalore, Oct 1, 2011 : The Kerala High Court has rejected a plea to review its earlier decision to allow Air India fix the compensations for the families of the victims of the Mangalore air crash of May 2010.

The petition was filed by the Arikkad Abdul Salam, whose son had died in the crash.

Earlier, a single bench had ordered that the victim’s families should be paid Rs. 75 lakh each, but a division bench reviewed this order on Aug 25 and revoked this order, while simultaneously rejecting a plea stating that Rs. 75 lakh is not sufficient.


 

Mangalore Air Crash

 

The division bench had revoked the single bench order after noticing that AI had paid an average compensation of Rs. 80 lakh for death with the minimum compensation being Rs. 25 lakh and the maximum compensation being Rs. 7.75 crore.

Following the court’s order, the Mangalore Air India Crash Victims’ Families Association decided to move Supreme Court and extended support to Abdul Salam.

Around 55 families have decided to take the battle to the Supreme Court to get paid according to international standards. The families had discussed the matter with an insurance company based in London, and the third round of discussions will take place shortly. The victims were also informed by their Swedish lawyers that so far the discussions have been favorable, and if they fail, the victims may approach the International Court of Arbitration.
