MANGALORE, Sep 18, 2013: The Fourth Additional District and Sessions Court has convicted two of the three arrested persons in the case of a gang rape of a minor girl from Odisha in the bogie of a stationed train in the Mangalore Central Railway Station.

The incident had taken place on July 14, 2010.

Though four persons were identified as accused, only here had been  arrested and of the two,  Nishith (20) a resident of Attavar and K Ashok (24) of Kadeshwalya in Bantwal have been convicted on September 17, Tuesday.


Meanwhile, another accused  Abdul Sattar alias Ayub (23) of Ullal Millatnagar has been acquitted on the grounds of lack of evidences. However, the first accused Shamisha of Payyanur is absconding. The court will  pronounce the punishment on September 19. A total of 27 witnesses had deposed before the court  in this case.

Of the accused Shamisha and the convict Nishit are permanent employees of the Railway Department while Ashok worked under a contractor. Abdul Sattar alias Ayub  was  selling tea and eateries in the railway station.

The victim  girl was a school drop out after eighth standard and was  appointed by one of her relative woman as domestic help in the house  at Kadri Alvares Road where a lone woman was residing. But the girl who was  homesick had escaped from the house when her employer had been to church on July 14, 2010 and had  arrived at the station.  


Three of the accused had  on seeing the girl sitting on the platform had enquired her when she said she wanted to go to Goa . They took her along assuring to take her to the train  and then took her inside the S 7 bogie of the Puduchery train and  raped  her  after closing the door. The girl who was unconscious was noticed by a sweeper who informed the police. The Child Line staff arrived and  the incident came to light.


The  case which was first heard by a Fast Track Court was later  transferred to the Fourth Additional District and Sessions Court.
