Mangalore, Feb 2, 2012 : The Karntaka High Court has cancelled an order passed by its single bench directing that a CBI investigation should be conducted into the murder of advocate Naushad Kashmiji.
The order, passed on Feb 2 Thursday, nullifies an earlier order passed by Justice Mohana Shantanagowdar on July 15, which was stayed on Oct 17 last year. According to the latest order, Naushad Kashmiji’s death will not be investigated by the CBI.
Naushad Kashmiji, the legal representative of Rashid Malbari, an associate of underworld don Dawood Ibrahim, was murdered near his apartment in Mangalore on April 9, 2009. According to a complaint lodged at the Pandeshwar Police Station by senior lawyer Purushottam Poojary, the murder was committed by four police officers who disapproved of his comments against the police made in court and because he was representing a person associated with terrorists.
Later, the CID investigated this case, but no progress was made. Naushad’s wife filed a writ petition in which she alleged that the police had filed a charge sheet against certain people they had arrested and requested a CBI inquiry into the murder. A single-bench court passed an order directing a CBI inquiry into the case, but the Mangalore police had challenged the ruling stating that they were capable of handling the case.
The ruling was nullified by the high court’s division bench, comprising Justice B. V. Nagaratna and Justice Vikramjit Singh.
