AI settles 138 cases in 22 months

Mangalore, Apr 13, 2012: Mulla & Mulla of Mumbai, the legal representatives of Air India (AI) has settled a total of 138 cases 22 months after the ill-fated Air India Boeing IX 812 crashed into Kenjar Valley, killing 158 passengers and crew members.

According to AI Chief Finance Officer Kapil Aseri, a total of 111 cases have been completely settled, 21 cases as per the ruling of the divisional bench of the Kerala High Court, and 6 partially and a total amount of Rs. 98 crore has been given away as compensation. During the past three days, 13 claims were settled, of which 11 were fully settled and 3 according to the ruling of the divisional bench of the Kerala High Court. Another case, which was partially settled, was now settled completely. 


Hoshang D. Nanavati of Mulla & Mulla said that the legal firm is doing its best to get in touch with all the families of the victims, except those who had hired the foreign legal firm, so that cases can be settled either completely or according to the judgment of the divisional bench of the Kerala High Court before the limitation period, that is May 22. 


The Montreal Convention sets a limit of 2 years for victims to make any claim. Regarding the case of Santhosh Rai who lost his wife and two children in the plane crash, Nanavati said that AI has compensated Mr. Rai as per the ruling of the divisional bench of the Kerala High Court, but he is free to file another case for more compensation.
