Mangalore plane crash – 812 Foundation files criminal case against AAI

Mangalore, March 5, 2012 : The 812 Foundation, founded jointly by Yashwant Shenoy, advocate Nayana Pai, and the female member of the family of a Mangalore plane crash victim, has filed a case in the JMFC court in Mangalore against those responsible for the Mangalore plane crash of May 22.


Air 1The case, which has been filed under the provisions of the Criminal Penal Code Section 200 focuses on the circumstances leading to the crash and those responsible for it than the amount given as compensation to victims’ kin. According to the 812 Foundation, the crash was the result of negligence on the part of those responsible. It has named Air India, the director general of civil aviation (DGCA), and Airports Authority of India (AAI) as respondents in the case.

The foundation has used the Right to Information (RTI) Act to find out everything related to the plane crash. It has also collected information regarding safety requirements, legal aspects, and norms of flying from foreign experts.

It intends to submit this information to the court and to request the court to direct the Panambur Police to register a criminal case, arguing that the case is a murder case as the crash occurred because of the AAI’s negligence.

The foundation has alleged that the ill-fated aircraft hadn’t been sent in for routine check up and had not be inspected for the past 4 – 5 years although an annual inspection is required. According to unconfirmed reports, the pilot who flew the aircraft was not licensed to fly such an aircraft.
