April 29: H D N hired by Air India (AI) after the tragic air crash that killed nearly 158 passengers and crew, has facilitated the release of compensation in case of 55 victims.


H. D. Nanavathi, an advocate in Mumbai, settled a few cases during his recent 3-day sitting with victims’ families in Mangalore and said that the firm is doing it best to settle all cases. He said that each case is being examined separately according to proof of loss and as per the Montreal Convention.


He said that many families have received over Rs. 75 lakh according to proof of loss and calculated to place family members in the same financial condition they would be in if the victim did not die. He further explained that the income factor is taken in consideration with level of dependency of family members on the victim. Explaining the delay, he said that some people were waiting for the verdict of a case filed at the Kerala High Court.


He also claimed that he has been suggesting that each family should have its lawyer with them during the sittings so that they can better understand the various restrictions and rules. He also refused to make any comment on the CoI’s findings and said that the report will be made public soon.


Meanwhile, reliable sources state that 64 families of victims have hired Stephan Eriksson, a Sweden-based advocate, to contest the case at the international court and demand higher compensation. The case will soon be filed in Dubai, say sources.
