Mangalore, Aug 29, 2013: The Second Additional District and Sessions Court here on Thursday sentenced Rashid Malbari of five years imprisonment and Rs 11, 500 fine to be paid, if failed he has to undergo one year additional imprisonment in the jail.

Rashid Malbari, said to be an aide of underworld don Chhota Shakeel has been convicted in a case of illegal possession of arms. Sessions Court passed the judgment on August 26. Malbari served four and half years in the custody till date, the court ordered him to serve the remaining period of the sentence.

Malabari’s associate Muhammad Hashim is also guilty of the same charges.


Public prosecutor Manjunath V Bhat Panne on Wednesday sought maximum punishment based on the report given by the investigating officer on the criminal background of the accused.


But another public prosecutor Shivaprasad Alva K, who conducted the case before Manjunath Bhat said there was no evidence against Malbari and his associates which showed their involvement in criminal conspiracy to kill Pramod Mutalik and Varun Gandhi in 2009.


Due to insufficient evidence, the district court also cleared charges against Malbari of murdering two alleged associates of ChotaRajan in Panambur in 2009.


At present, the cases pending against Malbari in Mangalore North Police Station is of masterminding murder of a person at Kanchana Textiles while he was in judicial custody, while the other has been registered in Barke Police Station for impeding a government servant.


Malbari’s case was first heard by fast track court judges Majjage and J D Narasimhamurthy who examined 14 witnesses. Later, the court was transferred to the fourth additional district and session’s court which declared Malbari and his associate Mohammed Hasim guilty, after B K Naik heard two witnesses.

The DCIB sleuths had arrested Malbari at Chattanchal in Kasargod  in March 2009 in connection with the murder of Shabbir Khan Murad Khan Pathak, a Chota Rajan aide in September 1997. He is also the prime accused in the case of attempted murder on Chota Rajan in Bangkok in 2000.

Malbari is also facing over ten cases in Mangalore, Bangalore and Mumbai stations.
