CJP protest: SC stays action against protesters in all States, orders immediate release of students

New Delhi, Jul 28, 2026: The Supreme Court on Tuesday directed that no coercive action be taken against protesters involved in the recent student protests led by the Cockroach Janata Party in Delhi’s Jantar Mantar and other States.

A Bench of Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V Mohana also ordered the immediate release of minors detained by the police across different States.

The court, however, clarified that this protection shall not extend to those with criminal background.

The directions were issued while hearing a batch of petitions alleging police excesses against protesters.

"Allegations of the petitioner make out a case for a fair and independent probe which shall also cover the concern of the family of police personnel. Before we form a committee, we allow the Union to place on record their version and also the States about the status of cases," the court said.

The court ordered the issue of notice to the Chief Secretaries of Delhi, Maharashtra, Bihar, Kerala, Madhya Pradesh, and Uttar Pradesh.

As an interim measure, the court issued the directions to the States and the police. It has asked the police to ensure that the digital data of protesters collected is preserved and not brought into the public domain.

The police have also been asked to preserve all CCTV, drone and body-worn camera footage, wirelessss communication record and PCR calls.
