Mangalore, July 14, 2014:  The Society for Fast Justice, a national level public forum for enabling ’Fast, Fair and Economic’ justice from the courts of all types all over India,  launched it’s Managalore Service Centre a interactive workshop on July 13  before seriously interested responsible cross section of Mangaloreans at Rohan Corporation conference centre at Balmatta.

DK Chapter of PUCL facilitated and hosted this inauguration at the hands of Sri.Pravin Patel, National Convener of the forum.

The representatives of the forum are scouring the country to establish 100 service centres, given the portfolio it is an easy target for a start, nearly 20 societies have been registered as of now and many have been formed and are being formwd. After several centres set up in the North of the country and a few in Tamil Nadu, Kerala, AP and now Karnataka according to Sri Patel.

It was unfortunate that the Chairman Sri. Bhaganji Raiyani had to return to Mumbai from due to unavoidable circumstances. Sri Patel, explained in fair detail how the litigants are facing untold hardship and delay in courts of all levels thorough out the country. Beside poor quality delivery of services from police, courts are a nightmare for the impoverished and middle class citizen. The few officials who are honest do not find their voice heard, corruption,nepotism and goondaism are at play in all aspects of law courts and delay is totally a wide spread harassment.

Politicians are a law unto themselves and  their  fraternity has a large percentage of  criminals Sri Patel detailed.  The President of the function P B D’Sa in his characteristic style said it is well past the time that organised resistance is put up to all the atrocities and injustice faced by common man from the Govt. and so on. Work Shop :  Sri Pravin Patel, a highly knowledgeable and experienced leader in the field,  dwelt on the following as an integral part of the workshop :
 
The present infrastructure in courts and the procedures adopted by them need modernisation and  improvement. Many courts do not even have needed buildings. Many areas have  no family courts, consumer courts and administrative tribunals.

Introducing  practice of written arguments instead of oral arguments that take a lot of time and to minimise adjournments have not been implemented effectively. Without progress in all these areas, time-bound and speedy disposal of cases is impossible. Computerisation is still far from the target.

The recent recommendation of the Law Commission of India set up a time slot for disposal of cases in courts to address the problem of long delays in functioning of the judiciary. Increasing the number of judges in high courts and other courts and/or  increasing in the retirement age of judges of the lower courts.  Chief Justice of India R M Lodha suggested that courts can work all the year round by giving judges their choice of holidays. At present, there are long holiday spells a colonial legacy.

  Very bad situation of pending  cases is well known to all. There are over 3.2 crore cases pending now, with about 65,000 in the Supreme Court and about 45 lakh in the high courts. A former judge projected some time ago that at the present rate of disposals, it will take at least 400 years to clear in the Delhi high court! Every court is short of judges and moves to increase the number of judges have taken off and vacancies are all over.

At the high court level, there is a 30% shortfall in the number of judges and 20% at the district level. The proposal for fixed clearance of cases will not work without increasing the number of judges and infrastructures.  India has only 12 judges for every million people. In some countries where there is a reasonably efficient judicial system, the judges’ strength is 100 per one million citizens. Adjournments which is illegal beyond three in number, it is a regular feature to have any number now and no action is forthcoming on this. The haphazard systems followed by police in investigations and  confusing presentations in courts often cause miscarriage of justice.

Also, instead of the use of technology for proper  judgements the  method used by law enforcement agencies is ’Latty technology’. It is high time that the colonial  regulations are reformed and the jail situation too is modernised and made human. Fast, Fair and Economic justice is the aim of  the forum all over India.
