Praveen Nettaru murder case: Karnataka HC denies plea of accused to transfer them to Bengaluru jail

Bengaluru, Mar 22, 2024: The Karnataka High Court has rejected a petition filed by the accused in the Praveen Nettaru murder case seeking transfer to a prison in Bengaluru citing safety threat. The order was pronounced on Tuesday by a bench consisting of Justice M Nagaprasanna.

 

The court also directed to provide proper videoconferencing facilities at the respective prisons to facilitate communication between prisoners and defense counsel, along with headphones to ensure privacy.

The counsel for the accused petitioners stated that after they were transferred to Belagavi jail in 2023, two of them had been attacked in prison. It was therefore argued that they should be transferred to Bangalore Central Prison, which would save their lives and also give them easy access to the defense counsel.

On the other hand, Advocate General Sashikiran Shetty opposed these arguments, pointing out that the incident in Belagavi had not involved the accused but some other person. He further pointed out that public interest had to be served, and that the petitioners might hatch another conspiracy if kept in the same place.

The bench observed, "The learned advocate general would submit that safe keep of prisoners is the duty of the State. Some untoward incident happened one year ago would not mean the petitioners are entitled to come together and stay in one house, submission of the learned Advocate General is placed on record that, no untoward incident will happen."

A member of the Bharatiya Janata Yuva Morcha, Praveen Nettaru was hacked to death by two bike-borne attackers in Dakshina Kannada district’s Bellare village on July 26, 2022.
