May 09 2019: A Special PoCSO Court on May 8, Wednesday convicted two persons for gang rape of a minor girl and sentenced them to 20 year rigorous imprisonment and imposed a fine of Rs. 20,000 on them. Second Additional District and Sessions Judge B.R. Pallavi, who was the Special Judge, passed the orders against Sachin Kumar (22), a resident of Koppadabailu Mane, Koyyur in Belthangady taluk, and K.T. Mathew, alias Manu (24), a resident of Laila Patladi Ankaji Mane, for aggravated penetrative sexual assault on the girl.
While Mathew is an autorickshaw driver, Sachin is a manual labour.
When the victim, studying first PU, was returning home towards Koyyur on March 7, 2015, the accused, who were in a car, promised her to drop her home and took her away in the car despite her protests.
The accused did not drop the girl near her house and instead drove to a secluded location before raping her, investigating officer and the then Circle Inspector of Police B.R. Lingappa said in the charge-sheet.
As the girl did not return home at the usual time of around 3.30 p.m, her parents raised an alarm.
However, she returned later. On inquiry, the girl told her mother about the incident, following which a complaint was made with the Belthangady police.
Inspector Lingappa, who carried out investigation, launched prosecution through public prosecutor C. Venkataramanaswamy.
During trial, the prosecution submitted 23 exhibits, while 19 persons adduced evidence. The court concluded that the accused were guilty of the offences they were charged with and sentenced them.
If the convicts fail to pay fine, they would have to undergo an additional six months imprisonment.
Out of the Rs. 20,000 fine, Rs. 18,000 has to be paid to the victim, the court said and added that the victim may approach the Legal Services Authority for additional compensation.
