Mangalore, Mar 13: The state High Court has issued an order to the effect that the playground around which the Padua High School management has constructed a compound wall belongs to the government. Reportedly, the High School was in the wrong while constructing the compound wall. 

The deputy district commissioner had granted the school conditional sanction to use a 6.16 plot near Kadri Park as a playground; and the general public was not allowed into the plot. Udaya, a resident of the locality, filed public interest litigation in the state High Court, challenging the action of the Padua High School management. Accordingly, the High Court division bench comprising Justice B S Patil and Justice V Gopal Gowda has issued an order preventing the construction of buildings in the plot. 

According to the High Court, the land’s rights transfer certificate is in the name of the government. Therefore, the court has declared the school’s recent activities of digging a bore well, constructing a compound wall, and digging trenches for the construction of a building on the said plot as illegal.

Advocates Dilraj Rohit Sequeira and Rajesh Rao Kumble had represented the petitioners.
