High Court orders Omega Hospital to pay Rs. 17.5 lakh compensation

Mangalore, May 30, 2012 : The Karnataka High Court has ordered Omega Hospital to pay Rs. 17.5 lakh as compensation to the family of Mohammed Ashraf of Bhatkal, who became brain dead because of medical negligence at the hospital 10 years back.

Mr. Ashraf visited Dr. Mukund of Omega Hospital in 2002 because he was suffering from chest pain. On September 15, Dr. Mukund and a team of doctors, including cardiothoracic surgeons Dr. A. J. Jayakrishna and Dr. Jithendra Kumar Rathod and cardiac anesthetist Dr. Gopal Kumar performed a cardiac surgery on Mr. Ashraf.

Unfortunately, Mr. Ashraf became brain dead because of faulty heart and lung apparatus used in the hospital.

Mr. Ashraf’s wife lodged a complaint at the local police station and at the DK District Consumer Disputes Redressal Forum. When the forum ordered the hospital to pay Rs. 15 lakh as compensation to the widow, the hospital decided to challenge the forum in court.

The high court ruled in favor of the widow and ordered the hospital to pay Rs. 17.5 lakh as compensation.
