Kesavananda Bharati Verdict highlights significance in Constitutional Jurisprudence: Goa Governor

Mangaluru, Dec 10, 2023: The historic value of democracy was upheld by the verdict in the Kesavananda Bharati case, said Goa Governor P.S. Sreedharan Pillai speaking on ‘Keshavananda Bharathi Judgement and Growth of Indian Constitutional Jurisprudence” symposium at SDM Law College auditorium in Mangaluru on Saturday. The event was organized by the Mangalore Bar Association, Kesavananda Bharati Verdict Golden Jubilee Celebration Committee, Edneer Math and SDM Law College.

Speaking on the significance of democracy in the constitution, Kesavananda Bharati emphasized that democracy is the primary feature. Even though Kesavananda Bharati lost the case, the verdict has elevated the essence of the entire constitution. The Governor commended the celebration of the Golden Jubilee of the verdict, stating that it is commendable for emphasizing the historic importance of the constitution.

"The imperative at this moment is to reconstruct India as ’Bharat’ in alignment with its core values. Value-based politics, coupled with collaborative nation-building efforts from the executive, legislature, and judiciary, will collectively strive to realize the nation’s overarching goals," he emphasized.

Acknowledging the effectiveness of our existing system in providing pragmatic ideas for progress, the Governor of Goa stressed the necessity for ignited and healthy debates, dialogues, and productive discourse. These, he asserted, are essential elements in constructing a resilient society as the nation navigates through the challenges of the turbulent 21st century.

Furthermore, the Governor highlighted the importance of drawing inspiration from noble ideas from other nations. However, when it comes to dealing with the Indian Constitution and laws, he cautioned against blindly adhering to a ’Look West’ policy.

Elevating the discussion, N. Vinaya Hegde, Chancellor of Nitte University, emphasized that the basic principles of the constitution have not changed despite various amendments. This verdict serves as evidence that fundamental rights in the constitution are always secure, he said.

The symposium witnessed the presence of K. Prithviraj Rai, President of the Bar Association, Shridhar Enoj, Chief Executive Officer, and Dr. Taranath, Vice Principal of the college.
