ABAP demands probe into male friend’s role in Deralakatte case

Mangalore, Jan 5, 2014: K S Sharma, national member of advocate organization Akhil Bharatiya Adhivakta Parishad said that charges against the eight accused of Deralakatte case are not strong to put them behind bars, but will make them escape from the law.

Speaking at the press meet held at Hotel Woodlands on Jan 5, Sunday he said that the victim in her complaint stated that the accused had molested her and even forced her to have sex with her male friend, but in this situation, the police officials have failed to register a rape case under the section 376(D).


Sharma also said that even though the case is intense, the police officials have failed to charge suitable IPC sections like 375(b), 375(C), 376(D) and 201 for criminal conspiracy, destruction of evidence, gang rape and others.


The victim in her complaint had also mentioned that her male friend Dr Hambul, who was also kidnapped with her, had spoken to the accused, but police had not investigated Dr Hambul regarding their conversation, but was sent to his native place Kerala after the incident. Hence the police should have interrogated Dr Hambul, since the person who has been threatened by the accused may not perform sexual intercourse with his friend unless his mind permits, he said.


Sharma also said that after the incident, the victim was not subjected to medical examination or counseling. The accused, who come from criminal background must b charged with sections like 375(b), 375(C), 376(D) and 201 o they cannot escape from law. 


He also said that if the actions are not taken against the accused, Akhil Bharatiya Adhivakta Parishad will take the responsibility to submit this case to the High Court and will fight for justice. The investigation must be conducted under the surveillance of High Court in this regard, he said.


Sudhakar Jolli, Ramkrishna Rai, Ravichandra P M, Jagadish Kaup Male, Captain Brijesh Chowta was present on this occasion.
