Tengpora killing: SC stays contempt proceedings against Srinagar top cops

New Delhi, Aug 09, 2016: The Supreme Court on Tuesday stayed contempt proceedings against top Srinagar police officers for allegedly disobeying a court order to register a case against a DSP for allegedly killing a protester.

The man is one of the 56 people to have been died in the unrest that has rocked the Valley following the encounter death of Hizbul Mujahideen militant Burhan Wani.

The Srinagar chief judicial magistrate on Monday forwarded a request to the Jammu and Kashmir high court to start contempt proceedings Kashmir inspector general Syed Javaid Mujtaba Gillani and Srinagar top cop Amit Kumar.

It also asked the two officers, who were given bail, to appear before the high court on Tuesday morning.

The Supreme Court gave relief to the officers after the Jammu and Kashmir government said they were not given time to challenge the CJM’s decision.

The Srinagar court had asked Kumar to register an FIR and investigate deputy superintend of police Yasir Qadri on the complaint of the father of a youth who was killed in the Tengpora area of the city on July 10.

In his application to the court, Shabbir Ahmad Mir’s father said his son was shot dead by the DSP, who led a police party into their home.

The court directed the SSP, first on July 18 and again on July 28, to file the FIR and appear personally if the complaint was not lodged.

It also issued a non-bailable warrant against the SSP on July 30 after he sought exemption from personal experience.
