No promotion or award for cops involved in fake encounters: Supreme Court

New Delhi, Sep 23, 2014: The Supreme Court on Tuesday said the policemen accused of staging fake encounters should not be promoted or given a gallantry award.

Issuing a set of guidelines for the police, the apex court said the government should order immediate filing of a First Information Report and a magisterial probe into the incident in case of a fake encounter.

The Supreme Court said the cases of fake encounters should be investigated independently either by the Criminal Investigation Departments or a separate police station.

"The Supreme Court has come out with extensive guidelines on fake encounters which will be treated as law under Section 144," petitioner Surat Singh told Headlines Today.

The police in India has often been accused of staging fake encounters to eliminate the accused by various human rights organisations.

The Supreme Court, however, on Tuesday said the National Human Rights Commission should not intervene in all cases of police encounters unless there is a serious apprehension that the encounter was fake.

The apex court also allowed anyone with a grievance over an alleged fake encounter to file a case in a sessions court.
