FSSAI initiates legal action against Nestle India over infant nutrition products

New Delhi, Sep 18, 2026: The Food Safety and Standards Authority of India (FSSAI) on Friday said it has initiated legal action against Nestle India Ltd over alleged violations of food safety regulations involving three infant nutrition products.

The food safety regulator examined NAN Excella Pro Stage 1, Lactogen Pro 1 and a follow-up formula, along with promotional material for the products available on e-commerce platforms.

According to FSSAI, promotional claims related to “5HMOs” and “Whey Protein” were flagged in NAN Excella Pro Stage 1. In Lactogen Pro 1, the regulator raised concerns over a claim describing whey protein as easy to digest.

FSSAI said it had sought clarifications from Nestle India regarding the claims.

The regulator said both products were found to be in violation of Regulation 4(2) of the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020. The provision restricts promotional claims and materials intended to increase the saleability of infant foods.

The products were also found to contravene Section 3 of the Infant Milk Substitutes, Feeding Bottles and Infant Foods (Regulation of Production, Supply and Distribution) Act, 1992, which prohibits the advertisement and promotion of such products.

Separately, a sample of a Nestle India-manufactured follow-up formula was found to be sub-standard for biotin content during laboratory testing. The sample was subsequently sent for re-analysis, with the referral laboratory also finding it non-conforming with the biotin requirement prescribed under the 2020 regulations.

Following the findings, FSSAI said it has filed three separate adjudication cases against Nestle India in connection with the three products.

Meanwhile, Nestle India shares were trading nearly 2% lower at Rs 1,345.45 on the BSE at 1.10 pm on Friday.
