Calcutta HC grants protection to TMC MP Abhishek Banerjee from arrest in three cases

Kolkata, Aug 25, 2026: The Calcutta High Court has granted TMC MP Abhishek Banerjee protection from arrest until November 30 in connection with three FIRs registered against him.

“Custodial interrogation of the petitioner is not necessary,” the bench said, directing the police not to take any coercive action against Banerjee until November 30, 2026, or until further orders, whichever is earlier, Bar and Bench reported.

The court also clarified that Banerjee may travel abroad for medical treatment as permitted by the Supreme Court in its August 10 order. The apex court had allowed the TMC MP to travel abroad for three weeks for eye treatment.

The High Court observed that if Banerjee had appeared before the medical board, the court could have considered the medical experts’ opinion to determine whether he needed to travel abroad for treatment.

The high court noted that had Banerjee appeared before the medical board, based on the opinion furnished by the medical experts, the issue could have been examined by the court in order to find out whether he needed to go abroad for treatment or not.
