Court sets aside proceedings against Sharan Pumpwell

Mangaluru, Feb 12 2018: The III Additional District and Sessions Judge B. Muralidhar Pai has set aside security proceedings initiated by Deputy Commissioner of Police (DCP) (Law and Order) Hanumantharaya against Vishwa Hindu Parishad Mangaluru Division Secretary Sharan Pumpwell.

Mr. Pumpwell had filed a criminal revision petition before the court questioning the summons issued by Mr. Hanumantharaya to him on November 8, 2017. Exercising power vested under Seciton 113 of the Criminal Procedure Code, Mr. Hanumantharaya by his order had directed Mr. Pumpwell to show cause as to why he should not be called upon to execute bond of Rs. 10 lakh for maintaining peace in the area.

Mr. Pumpwell contended that the order was issued to prevent him from doing protest on Tippu Jayanti.

Allowing the petition, the Judge in his order dated January 30 said the November 8 order does not indicate any basis for presuming threat to peace and tranquillity by Mr. Pumpwell.

The impugned order, the Judge said, has been passed without any application of mind. There was no valid reason for the DCP to initiate proceedings under Sections 107, 116 (3) and 111 of the Criminal Procedure Code, the Judge said.
