Mangaluru: Man arrested for sharing sexually explicit photos of girl

Mangaluru: September 25, 2015: The district and sessions court sentenced an employee of a private hospital to six months of imprisonment and imposed a fine of Rs 40,000 on finding the accused guilty of capturing sex with a woman without her consent and transmitting it to his friends.

Ashok, who captured on his mobile phone the sexual act with a 21-year-old neighbour, was found guilty by sixth additional district and sessions Judge DT Puttarangaswamy.

Ashok was also accused of sending these images to persons in his locality. Police said Ashok, a resident of a village near Moodbidri, brought his neighbour’s daughter to the city assuring her of a job in a local hospital in February 2009. They stayed in a lodge where they had sex. Ashok captured it on his mobile without her consent. The complainant subsequently returned to her village and after a few days left with Ashok for Mumbai.

Her mother, who didn’t know about the tour, filed a missing persons complaint. When she returned from the tour, the woman hushed up the matter saying she had gone with her friend.

Ashok had retained images of his sexual escapade on his mobile phone. On June 21, 2010, he sent the images to a few neighbours.

The woman and her family members who saw the images lodged a complaint with Moodbidri police, who arrested Ashok.

The victim during examination by prosecutor Judith O M Crasta informed the court that Ashok had captured the images without her consent. TN Ramakrishna, forensic expert, told the court the images captured were that of Ashok and the complainant. The judge convicted Ashok under Sections 66 (E) (Punishment for violation of privacy) and Section 67 (A) (Punishment for publishing and transmitting sexually explicit content) of IT Act 2000.

The judge also found him guilty under sections 417 (punishment for cheating) and 506 (punishment for criminal intimidation) of the IPC. The judge directed him to pay Rs 35,000 of the total fine of Rs 40,000 to the woman as compensation.
