District judge stresses need for arbitration to speed up cases

Mangaluru, July 17,2017: Speaking after inaugurating a three-day training workshop for the arbitrators organised by Karnataka State Legal Services Authority, Bengaluru, in association with District Legal Services Authority and Udupi Bar Association, Udupi District and Sessions magistrate Venkatesh Naik said the arbitration is the need of the hour as the shortage of magistrates has increased the number of pending cases in the country.

The judge went on to say that the pendency of cases is increasing and in Udupi district, 23,000 cases are pending from 1968 till date. In this backdrop, arbitration seems to be the alternative way to end up the pendency enabling the early disposal of the files, he said.

Earlier, the legal process was simple and an easy process. Panchayats and village heads were solving the issues within the set-up. Now, the scenario has completely changed. The judiciary with the normal trials and proceedings are ending up as laborious process. Arbitration will come handy as the both parties will be called for sorting out differences amicably. Mediation is a better way of sorting out civil issues, he said.

Asserting that the arbitrators should have in-depth knowledge of legal implications, the magistrate said the arbitrators can work towards deciphering the cases and around 25% of the cases would be sort out through negotiation.

Veteran advocate Madhav Achar said that the mediation will help to realise the concept of social justice as both the sides will come to amicable consensus to end up the differences. It is helpful to solve the complicated cases as there will be no injustice to the parties involved, he added.
