CBI files ’B’ report in former DSP Ganapathy suicide case

November 22, 2019:  The Central Bureau of Investigation (CBI) has filed a ‘B’ report in the Deputy Superintendent of Police M.K. Ganapathy case, dating back to 2016, by telling the court that there is no evidence that former Home Minister and Congress leader K.J. George, and senior IPS officers Pronab Mohanty and A.M. Prasad had abetted his suicide.

 

The CBI probe has concluded that allegations levelled by Ganapathy against the accused (in a video prior to his death) were found to be “very vague, not cogent, and very old”.

It further said the allegations show that he, “contrary to facts, has imagined many issues and levelled these allegations” more out of a “depressed mindset than out of conviction and facts”.

 “Though the death of Ganapathy is very unfortunate, there is no evidence to show that the accused or anybody else instigated, provoked, abetted, or compelled the deceased to commit suicide,” said the CBI.

Ganapathy, a DySP posted in Mangaluru, was found dead at a hotel in Madikeri on July 7, 2016, hours after giving an interview to a local television channel in which he accused the then Home Minister George and the two senior IPS officers of harassment, blaming them for “anything that happens to him”.

The case created a political stir and Mr. George had to resign as Minister. The Criminal Investigation Department (CID), Karnataka, and a judicial inquiry committee gave the accused a clean chit and Mr. George made it back to the ministry.

However, on the appeal of the family of the deceased, the case was handed over to the CBI by the Supreme Court.

The CBI report lists out all allegations Ganapathy made against the three accused in his last interview, and investigations have disproved each one of them. On the allegation that Mr. George held a grudge against Ganapathy for cases filed against Christians in the 2008 church attack case, the CBI said the allegation was unfounded.

On the contrary, the CBI has said as Home Minister in 2015, Mr. George refused CBI permission to prosecute the officer in the lawyer-media clashes and reinstated him after suspension when the deceased met him, indicating Mr. George had no grudge against the officer, and in fact “rather helped him”.Ganapathy had alleged that Mr. Mohanty had demanded money from him when he served as inspector in Madiwala and was harassing him when he was in the Lokayukta.

The CBI found that when Ganapathy was Inspector of Madiwala police station, Mr. Mohanty was Joint Commissioner (Crime) and the former did not report to him, and demands for money “were found to be not true”. Further, no adverse remarks were made over Ganapathy’s promotion as Dy.SP by Mr. Mohanty, who was IGP, Lokayukta Police, indicating he was not vindictive.

The CBI said neither Mr. George nor Mr. Prasad, who was ADGP, Intelligence, made any adverse remarks on his promotion. Allegations that Mr. Prasad held a grudge against Ganapathy were also found to be false. Contrary to allegations, Ganapathy mostly held executive postings throughout his career, the CBI found.
