Assault case of RTI activist: Court imposes Rs. 10,000 fine on accused

Mangaluru, Nov 02, 2017: Principal District and Sessions Judge K.S. Bilagi on  Dec 1, Friday imposed a fine of Rs. 10,000 each on four persons after finding them guilty of assaulting a Right to Information activist here two years ago. The Mangaluru Rural Police arrested Surendra B. Kambli, Pramod Alva, Mohammed Rameez, Siraj and Anwar for allegedly assaulting Tyampanna Shetty, 62.

 

Assault.In the charge sheet, the police said Kambli held a grudge against Mr. Shetty over the latter’s complaint to district authorities on former’s alleged illegal sand extraction activity.

The accused reportedly came in a car and assaulted Mr. Shetty near Adyar Katte on February 11, 2015, at 9.15 a.m.

The accused had been charged under Section 307 of Indian Penal Code (attempt to murder). Public Prosecutor Pushparaj Adyantaya had examined nine witnesses.

The judge acquitted Pramod Alva while the other accused were convicted under Section 324 (voluntary causing hurt using dangerous weapons) of the IPC. The judge did not find any evidence for the charge under Section 307 of IPC.

The judge imposed a fine of Rs. 10,000 to the four convicted persons and directed that half of the total fine amount should be paid as compensation to Mr. Shetty.
