A 25-day jail term for man, but acquitted of rape

Mangaluru, Oct 25, 2017: The sixth additional district sessions court on Oct 24, Tuesday sentenced a person to a 25 day  imprisonment for threatening and assaulting a divorced woman. However, the court acquitted him of rape charges and observed that physical intimacy between the duo was consensual, and not forceful.


jail 25 oct 1In 2014, a divorcee, working at a medical shop accused Yogish, 33, an electrician and resident of Kotimura in Kulshekar, of rape, assault and threatening her. The woman alleged that Yogish had befriended her and the two were in constant touch. On New Year, Yogish had sexually assaulted her and continued to do so. He had promised to marry her, the woman told police. However, he later backtracked and assaulted and threatened her with dire consequences.


She filed a case at Mangaluru Rural police station when Yogish continued to harass her. Public prosecutor Judith O M Crasta said that as many as 12 witnesses were examined and 27 documents produced. The district court after hearing witnesses ruled out rape terming it as consensual sex and also dropped cheating charges as the victim told the court that she had dumped the accused when she realized that he was not of good character.


The sixth additional district and sessions judge D T Puttarangaswamy declared him guilty under Indian Penal Code (IPC) 323 and 506. He was sentenced to 25 days in jail and fined Rs 20,000 which is to be given to the victim as compensation.
