Mangaluru, Nov 27, 2015: The Third Additional District and Sessions Court which has on November 27, Friday announced the quantum of punishment to the five convicts in the Advocate Naushad Kashimji murder case has sentenced three of the convicts to a rigorous life imprisonment under IPC Sections 302 and 120 B apart from a penalty of Rs 20,000 each.
They will have to undergo an additional five years of rigorous imprisonment if they fail to pay the penalty.
Ritesh alias Reethu Kodikal, Dinesh Shetty of Nayataru in Belthangady and Pratap Shetty of Kavoor are the tree convicts sentenced to rigorous life imprisonment. The Court has also sentenced the three to seven years of rigorous imprisonment apart from a penalty of Rs 5,000 under IPC Sections 3 and 25.
The other two convicts namely Subrahmanya of Kadri and Ganesh from Kodikal, were sentenced to seven years of rigorous imprisonment under IPC Section 201 apart from a penalty of Rs 10,000. They will have to undergo another three years of rigorous imprisonment if they fail to pay the penalty. The Court has also sentenced the two to an additional six months of rigorous imprisonment apart from Rs 5,000 fine under IPC Section 202. In case they fail to pay the penalty, they will have to undergo an additional imprisonment of five months. All the five were convicted by the court on November 25.
The Court has said that the penalty amount will be handed over as compensation to the family of Naushad Kashimji.
Naushad who was the legal counsel for Rasheed Malbari said to be a close aid of underworld don Dawood Ibrahim, was shot dead by assailants at Falnir on April 9, 2009.
Naushad Kashimji’s brother Sameer Kashimji who was present at the court expressed happiness over the judgement and described it as a ’Victory for Justice.’ At the same time he said those who are convicted were only the supari killers and urged the authorities to arrest the real killers of Naushad Kashimji.
