Mangalore plane crash - victims’ families to approach Supreme Court

Mangalore, Sep 19, 2011 : The Mangalore Air Crash Victims’ Families Association has decided to move Supreme Court to get justice at a meeting held at Sahodaya yesterday.

This decision follows AI’s appeal to the divisional bench of the High Court questioning the ruling of the single bench of the Kerala High Court that the victim’s families should be paid Rs. 75 lakh. The divisional bench had ruled that AI need not pay Rs. 75 lakh.

Speaking on the issue, Mohammed Beary, the president of the association, said that AI is not ready to pay compensation that is due to the victims’ families, owing to which the families have decided to approach the Supreme Court.

Further, he said that the victims’ families should be compensated according to the Montreal convention and urged the central government to set up a separate court to deal with this issue. Around Rs. 15 lakh is required to fight the case in the Supreme Court, he said.

The association urged all those aggrieved family members to join the fight for justice against the national carrier. Treasurer Razak said that Patricia D’Souza of Shakthinagar who had received Rs. 10 lakh from the national carrier moved court and received Rs. 10 lakh more. He said that even families who have already received compensation and feel that they have not been compensated enough can fight in court and get more money.

Each family willing to take the case to the Supreme Court will have to pay Rs. 10,000 to Rs. 15,000, and those who have already received the compensation will have to pay as much as Rs. 30,000.

Advocate Shridharana said that the divisional bench’s decision is not final and that the victims will be successful if they move the Supreme Court. He said that a case has already been filed in the divisional bench to review the judgment recently given in favor of AI and that a verdict will soon be issued.

He also said that the case should be filed within 2 years, failing which the victims will not receive any compensation.
