Air crash victims not paid as per Montreal Convention recommendations

Mangalore, May 29: The AI appears to have overlooked the recommendations of the Montreal Convention while giving compensations to the families of the plane crash victims. Lawyers hired by some of the bereaved families asked AI the uncomfortable question of whether the AI was awarding compensations as per the recommendations of the Montreal convention. Simply put, the families of the plane crash victims suspect that the compensation paid to them is much lower than that recommended by the Montreal Convention. 

 

Explaining the Montreal Convention further, a lawyer said that the Montreal Convention was adopted by countries with international flights operating from their country to another country. According to the recommendations of this convention, every individual who dies in an international plane crash must be given a compensation of USD 1,60,000 separate from the compensations announced by the national or state governments. This means that each bereaved family should be getting over Rs 76 lakhs; and AI will have to give huge sums of money as compensation to the families of the victims. The insurance companies will have to reimburse the money to the airline company. 

In this case, the families of the plane crash victims and their lawyers feel that the company is overlooking the Montreal Convention recommendations to avoid paying huge sums of money as compensation. 

The AI officials are yet to comment on this issue.
