Treat transgenders as third gender for job benefits: Supreme Court

New Delhi, Apr 15, 2014:  In a landmark judgement, the Supreme Court has asked the Centre to treat transgenders as the third gender or category and grant them all facilities including a voters ID, passport and driving licence.

transgendersThe court today asked the Centre to treat transgenders as "socially and economically backward", to enable them to get reservations in jobs and education.

"Transgenders are also citizens of India. It is the right of every human being to choose their gender. The spirit of the Constitution is to provide equal opportunity to every citizens to grow and attain their potential, irrespective of caste, religion or gender," the court said.

The National Legal Services Authority had petitioned the top court seeking equal rights for this group of people, saying that even hospitals did not admit them.

The court expressed concern at the discrimination and said the Centre and states must work to raise awareness on them and make sure they have access to medical care and other facilities like toilets.

Reacting to the order, former Election Commission SY Quraishi said, "When the Election Commission recognised transgender as the ’other’ gender besides male and female, one million of them got empowered. the Supreme Court has endorsed it."
