SC dismisses ex-IPS officer Sanjiv Bhatt’s petition against BJP chief Amit Shah

New Delhi, Oct 13, 2015: The Supreme Court on Tuesday dismissed a plea by sacked IPS officer Sanjiv Bhatt to make BJP chief Amit Shah a party to his petitions, alleging his harassment for certain disclosures in 2002 Gujarat riots cases.

A bench led by Chief Justice H L Dattu also lifted a stay on Bhatt’s trial in two cases and junked his petition which had initially sought taking away the probe from Gujarat police.

Bhatt has been named as accused in two FIRs. In the first case, he has been accused of coercing a police constable to depose before a commission inquiring into the riots. The second FIR has been filed by former Gujarat additional advocate general Tushar Mehta for allegedly hacking his emails.

Bhatt has claimed these emails demonstrated complicity of Gujarat government with Shah and others who were being investigated for Sohrabuddin Sheikh fake encounter case.

Bhatt had recently moved a fresh plea, saying Shah and some other people should be made parties to his petition since the emails showed their collusion. He urged the court to set up a special investigation team to probe the two FIRs against him, contending he did not have faith on CBI anymore.

But the bench on Tuesday junked not only his fresh plea but also his main petition, in which his trial had been stayed since around three years.
